No reservation in promotion till July 15: HC to MP Govt

BHOPAL [Maha Media]: The State will not make reservation in promotion till July 15, an oral reply was given by the Government in the High Court. The High Court asked to explain the difference between the policies of year 2002 and 2025, on this the Advocated General stated that information will be presented in the next hearing. The High Court may not have put any kind of stay in its order on the petition related to reservation in promotion, he prayed. But when the bench of High Court of Acting Chief Justice Sanjeev Sachdeva and Vinay Saraf asked Advocate General Prashant Singh whether he could tell that in the meantime there will be no departmental process regarding promotion. 

On this, the Advocate General requested the court not to provide any kind of interim relief right now. At the same time, it was said that there will be no promotion till the next hearing i.e. July 15. The High Court issued a notice to the Government and sought a clear answer in the matter. The same answer was presented verbally by the Advocate General and informed about not doing any kind of departmental DPC. Court does not agree with the argument: Sapaks Sangh has filed a petition in the matter.  

In which the new promotion policy of Madhya Pradesh 2025 was challenged . Petitioner ’s lawyer Suresh Mohan Guru told the court that the new policy is contrary to the status quo order given earlier by the Supreme Court. At the same time, it has been implemented in haste to avoid the order in the case of RB Rai vs Madhya Pradesh Government. At the same time, in the case of Jarnail Singh vs Union of India in the Supreme Court, it has also been made clear that reservation in promotion can be given only when the representation of the concerned class is less.
